Supreme Court Tosses Obstruction Charges For J6 Defendants

Published

on

The Supreme Court ruled that the Department of Justice (DOJ) used an inappropriately broad interpretation of a federal statute to prosecute a former police officer who was charged because of his involvement in the Capitol riot on Jan. 6, 2021.

On Friday, the justices delivered the 6-3 decision in Fischer v. United States, ruling Joseph Fischer should not have been charged with “obstruction of an official proceeding” under the 2002 Sarbanes-Oxley Act. The statute has been used by the DOJ to charge more than 300 defendants with felonies in the more than three years since the riot, with the defendants facing a prison sentence of up to 20 years.

Writing for the majority, Chief Justice John Roberts stated that “to prove a violation” of the statute under the Sarbanes-Oxley Act, “the Government must establish that the defendant impaired the availability or integrity for use in an official proceeding of records, documents, objects, or as we earlier explained, other things used in the proceeding, or attempted to do so.”

Justice Roberts warned on Friday that the DOJ’s broad interpretation of the law to lock up demonstrators present at the Capitol on Jan. 6 “would criminalize a broad swath of prosaic conduct, exposing activists and lobbyists alike to decades in prison.”

The case has far-reaching consequences that go well beyond the hundreds of defendants who’ve been prosecuted in the aftermath of Jan. 6 — who now have grounds to appeal the most commonly charged felony from the riot. Two out of four charges against

‘We Are Men And Women’: Texas Supreme Court Upholds State Protections Against Child Transing

The Texas Supreme Court ruled on Friday to uphold a Lone Star State law that effectively bans gender experimentation on children.

In an 8-1 decision published on Friday, the highest court in the state confirmed the legislature’s May 2023 law prohibiting health care professionals from castrating and mutilating minors does not violate the state constitution, as a trial court had previously concluded.

In fact, Justice Rebeca Aizpuru Huddle, joined by Chief Justice Nathan Hecht, Justice Jeff Boyd, Justice John Phillip Devine, Justice Jimmy Blacklock, Justice Brett Busby, Justice Jane Bland, and Justice Evan Young, affirmed in her majority opinion that the state has a vested interest in protecting children.

“Indeed, we have never held that a fit parent’s interest in caring for her child free from government interference, though weighty, triggers heightened scrutiny of every statute that restricts any asserted right connected to that interest,” Huddle wrote.

Huddle confirmed that the court believes kids, including those struggling with their sex, “deserve the most appropriate treatment together with support, love, and empathy.” She stopped short, however of pinpointing “the most appropriate treatment for a child suffering from gender dysphoria.”

Justice Blacklock, joined by Justice Devine, was far more hard-hitting about the parents and practitioners prescribing irreversible damage to kids as a solution in his concurring opinion.

“We are men and women, irreducibly and inescapably, no matter how we feel. Proceeding from these moral and philosophical premises, the Traditional Vision naturally holds that medicinal or

Tractor Supply’s DEI Reversal Shows The Power Of Citizen Activism

Published

on

Tractor Supply announced Thursday it is no longer implementing neo-Marxist initiatives throughout the company, marking a rare win for conservatives seeking to restore sanity to American institutions.

“We work hard to live up to our Mission and Values every day and represent the values of the communities and customers we serve,” a company press release reads. “We have heard from customers that we have disappointed them. We have taken this feedback to heart. Going forward, we will ensure our activities and giving tie directly to our business.”

The announcement came after conservative filmmaker and former congressional candidate Robby Starbuck unearthed the company’s infatuation with so-called “diversity, equity, and inclusion (DEI),” a poisonous left-wing framework that dismisses merit and instead discriminates based on characteristics such as skin color and sex. Individuals who qualify for a certain position on merit but don’t meet the discriminating entity’s goal of being more “diverse” are often passed over in favor of those who meet institutionally preferred identitarian standards.

Over the course of several weeks, Starbuck revealed how Tractor Supply implemented these left-wing ideologies throughout its company and financially supported related causes. Some of the policies adopted by the outdoor retail giant included publishing charts analyzing how many racial minorities it hired, flying LGBT flags at distribution centers, and partaking in LGBT “pride” events.

Media Finally Admit Biden Poses Grave Danger To Country After Years Of Defensive Coverage

Published

on

Last week, the White House and its left-wing media apparatus adopted a new phrase, “cheap fakes,” to try and deflect from the decrepit president, Joe Biden. But there was nothing “fake” about Biden’s Thursday debate performance, which is why the left is now openly — and rightfully — questioning Biden’s fitness for office.

But make no mistake, the media’s deliberate gaslighting of the American public for years about Biden’s health and mental agility has put us in grave danger, and calls for Biden to be replaced are a tacit admission of that.

Axios’ Alex Thompson said on CNN in the wake of the debate that the White House had gaslit and lied not only to the American people about Biden’s age, but also to reporters.

While it may be true that the White House gaslit the public, the media deserves to shoulder just as much blame as the White House, if not more. It doesn’t take an expert to see Biden falling up the stairs, over sandbags, and off his bike to question his physical limitations. It certainly doesn’t take an expert to hear Biden’s incoherent gaffes and mumbling to question his mental acuity.

If an 81-year-old showed up for a job interview acting the way Biden does, he’d be sat in a waiting room until police could determine which nursing home he escaped from. So, an actually functioning press would have relentlessly covered this clear danger to our national security, but instead they published whatever talking points the
